The following Terms and Conditions document is a legal agreement between Tech Lifter Solutions, hereafter the “Developer”, and “the Client” for the purposes of website design or development. These Terms and Conditions set forth the provisions under which the Client may use the services supplied.
The Developer is an Internet web design provider offering the Client graphical design, HTML, CSS, Javascript, PHP, WordPress (and WooCommerce) and other related computer programming languages.
Tech Lifter Solutions will estimate the cost of the project. The estimate is based upon the Client’s description of tasks wanted and supplied by the Client. This may be from a meeting or via email. A cost estimate will be provided.
If the Client requests more work to be done than what was initially agreed upon, extra time required to make changes to the website will be charged for at our standard rate.
To enable you to provide your services, your customer must work with you throughout the web development process and cooperate. Accordingly, your terms and conditions should clearly outline the responsibilities of the customer. In particular, the customer should:
We will provide the Client with an expected project completion date (live on the Internet) if requested. We will endeavor to meet any given deadline, but we do not guarantee and are not bound in any way to complete the project by this date.
Tech Lifter Solutions shall not be held responsible for delays to site development arising out of the Client’s delays in providing graphics, text and content in a timely fashion. If the website is not completed or work is halted by the Client’s request, refunds for work completed will be not be given.
Tech Lifter Solutions is not responsible for other contractors, developers or designers who may edit the Client’s website or change code that is authorized by the Client. There will be a fee to restore the site in case of loss or corruption of original design.
Unless agreed otherwise with the Client, all website design services require an advance payment of a minimum of fifty (50%) percent of the project quotation total before the work is supplied to the Client for review. A second charge of fifty (50%) percent is required after completion of the work, prior to upload to the server .
If payment is more than 15 days past due, a 500.00 Rs late charge will apply per day. Tech Lifter Solutions reserves the right to remove any web services from viewing on the Internet, to include email access, if payments are not made. If web services are suspended, a Rs.1000.00 re- activation fee will be applied to any outstanding balance before services are restored. In case collection proves necessary, the Client agrees to pay all fees (including all attorney's fees and court costs) incurred by that process.
As a policy, we do not offer credits or refunds for hosting time already expended or for work that has already been performed. Third party software purchased and/or installed on the clients account is non-refundable and without warranty by Tech Lifter Solutions. Any work or service that is performed under a Work-Made-For-Hire agreement is non-refundable. Payments made to sub-contractors for required programming and/or special elements requested by the client are non-refundable.
If cancellation is done by Tech Lifter Solutions due to restrictions violation, there will be no refund. Tech Lifter Solutions will only allow for refunded amounts if cancellation is not the fault of the client, as determined by Tech Lifter Solutions. All monetary transactions are in Rs(INR) rupees. Additional features can be added at any time. Monthly feature prices are not prorated. Tech Lifter Solutions reserves the right to change prices at any time.
Payment for services is due by cheque or bank transfer. Cheques should be made payable to Tech Lifter Solutions s and sent to Tech Lifter Solutions s, #469, 1st Floor, Shravedha, 2nd Main Rd, 3rd Block, HBR Layout, Bengaluru, Karnataka 560043. Bank details will be made available on invoices.
To cancel your account, please submit a request to us using our "Contact Us" form or call us at 9844321454 . We may send you an email to confirm that you wish to cancel.
Tech Lifter Solutions is a small business, to remain efficient we must ensure that work we have programmed is carried out at the scheduled time. On occasions we may have to reject offers for other work and enquiries to ensure that your work is completed at the time arranged.
This is why we ask that you provide all the required information in advance. On any occasion where progress cannot be made with your website because we have not been given the required information in the agreed time frame, and we are delayed as result, we reserve the right to impose a surcharge of up to 25%. If your project involves Search Engine Optimization we need the text content for your site in advance so that the SEO can be planned and completed efficiently.
If you agree to provide us with the required information and subsequently fail to do within one week of project commencement we reserve the right to close the project and the balance remaining becomes payable immediately. Simply put, all the above condition says is do not give us the go ahead to start until you are ready to do so.
NOTE: Text content should be delivered as a Microsoft Word, email (or similar) document with the pages in the supplied document representing the content of the relevant pages on your website. These pages should have the same titles as the agreed website pages. Contact us if you need clarification on this.
Using our content management system you are able to keep your content up to date yourself.
We may have written a lot of website content but we’re not responsible for the writing of or contribution of any text copy unless we have specified it in the original estimate. We’ll be happy to help though, and in addition to the estimate we will charge you at our standard hourly rate.
You will supply us photographs in digital format. If you choose to buy stock photographs we can suggest vendors of stock photography or we can purchase it on your behalf at our stock photography fees (fees provided on request). Any time we spend searching for appropriate photographs will be charged at our standard hourly rate.
Client agrees to reimburse Tech Lifter Solutions for any additional expenses necessary for the completion of the work. Examples would be purchase of special fonts, stock photography etc.
Accounts unpaid fifteen (15) days after the date of invoice will be considered in default. If the Client in default maintains any information or files on Tech Lifter Solutions Web space, Tech Lifter Solutions will, at its discretion, remove all such material from its web space.
Tech Lifter Solutions is not responsible for any loss of data incurred due to the removal of the service. Removal of such material does not relieve the Client of the obligation to pay any outstanding charges assessed to the Client's account. Cheques returned for insufficient funds will be assessed a return charge of Rs.500 and the Client's account will immediately be considered to be in default until full payment is received. Clients with accounts in default agree to pay Tech Lifter Solutions reasonable expenses, including legal fees and costs for collection by third-party agencies, incurred by Tech Lifter Solutions in enforcing these Terms and Conditions.
Termination of services by the Client must be requested in a written notice and will be effective on receipt of such notice. E-mail or telephone requests for termination of services will not be honored until and unless confirmed in writing. The Client will be invoiced for work completed to the date of first notice of cancellation for payment in full within fifteen (15) days.
A link to Tech Lifter Solutions will appear in either small type or by a small graphic at the bottom of the Client's website. If a graphic is used, it will be designed to fit in with the overall site design. If a client requests that the design credit be removed, a nominal fee of 5% of the total development charges will be applied. The Client also agrees that the website developed for the Client may be presented in Tech Lifter Solutions portfolio.
Tech Lifter Solutions cannot accept responsibility for any alterations caused by a third party occurring to the Client's pages once installed. Such alterations include, but are not limited to additions, modifications or deletions.
Any notice,request,consent or communication (collectively a “Notice”)under this agreement shall be effective only if it is in writing and (A)Personally delivered, (B) sent by certified or registered mail, return receipt requested, postage prepaid , (C) sent by a nationally recognized overnight delivery service, with delivery confirmed, or (d) telexed or telecopied ,with receipt confirmed, as indicated below.
